SEATTLE — May 7, 2007 — Mobile Traffic Systems Corporation (MTSC), the exclusive licensee of the TrafficGauge patent portfolio and a subsidiary of Acacia Research Corporation (Nasdaq: ACTG), has filed a patent infringement lawsuit against some of the biggest companies engaged in the consumer global positioning system market. The lawsuit filed against Garmin USA, Inc. (Nasdaq: GRMN), Cobra Electronics Corporation (Nasdaq: COBR), TomTom, Inc. (Euronext: TOM2), and privately held Magellan Navigation, Inc. claims infringement of patents involving the display and transmission of wireless traffic information. The lawsuit was filed in a U.S. District Court in Alabama.
At the center of the lawsuit is the technology that delivers real time traffic information through GPS navigation devices. The technology allows the collection of traffic data from multiple sources, which then can be sent wirelessly to hand-held and mobile devices to visually display highway traffic maps and corresponding traffic congestion information. TrafficGauge®, Inc. has been selling products using this technology for four years and has validated the usefulness of its patent protected products
In its Complaint, MTSC asserts that products manufactured by each defendant infringe upon two U.S. Patents issued to TrafficGauge®, Inc. for which MTSC is the licensing partner.
Ryan Peterson, CEO, TrafficGauge Inc. developed the early work in wireless traffic information, which resulted in the awarding of two United States patents. TrafficGauge's proprietary technology set the stage for innovative wireless transmission of traffic information to wireless handheld and mobile devices.
“We support the lawsuit filed by MTSC as it relates to the TrafficGauge patent portfolio. We have worked incredibly hard, building technologies and creating a market for the visual display of wireless real-time traffic information. We provide an excellent service and have garnered a significant customer base. However, when large corporations ignore patent protection that the United States patent laws afford and take away market share it leads small companies like ourselves to the court system to protect intellectual property,” said Peterson.
This patented technology generally relates to transmitting, receiving, and displaying traffic information on portable handheld and mobile displays. It covers a variety of wireless distribution methods, such as FM radio and satellite, as well as the devices used to display the traffic maps. This technology enables users to identify traffic congestion and can be used with in-vehicle navigation displays and portable handheld units such as cell phones and PDA's. This wireless solution allows TrafficGauge to provide an affordable option to frustrated commuters to view traffic maps in-vehicle on navigators and hand-held devices.
